1. Agreement to Terms

By accessing or using Free Web Design's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

Free Web Design provides web design and hosting services. Our service includes:

Free Website Design: We design a custom website for your business at no upfront cost.
Monthly Subscription Plans: If you choose to keep your website, you select a monthly plan (Starter at $29/month, Business at $79/month, or Pro at $149/month).
Hosting & SSL: All plans include website hosting and SSL certificate.
Content Updates: Plans include a specified number of content updates per month.

3. The Free Design Process

Our "free design" offer works as follows:

You submit an application with your business information.
We design a custom website for your business at no cost to you.
You review the completed design.
If you love it, you choose a monthly subscription plan.
If you're not satisfied, you can walk away with no obligation or payment required.

4. Subscription and Payment

If you choose to keep your website:

You will be billed monthly based on your selected plan.
Payment is due at the beginning of each billing cycle.
We accept major credit cards and other payment methods as specified.
Prices are subject to change with 30 days' notice.

5. Cancellation Policy

You may cancel your subscription at any time with no questions asked. Please note:

Cancellation takes effect at the end of your current billing period.
Upon cancellation, your website will be taken offline.
We do not offer file transfers or website exports, as the design is part of our service.
No refunds are provided for partial billing periods.

6. Website Ownership

Your subscription provides you with the right to use and display your website while your account is active. The website design, code, and underlying technology remain the property of Free Web Design. Your business content (text, logos, images you provide) remains your property.

7. Content Updates

Each plan includes a specific number of content updates per month:

Starter Plan: 1 content update per month
Business Plan: 3 content updates per month
Pro Plan: Unlimited content updates

What counts as a content update: Content updates include minor changes to existing content such as text edits, image swaps, contact information updates, business hours changes, and similar adjustments to your current website.

What is NOT included: Content updates do not include major redesigns, adding new pages, structural changes, new features or functionality, e-commerce setup, or any work that goes beyond editing existing content. These requests will be quoted separately.

Additional updates: If you need more updates than your plan allows, additional updates are available:

+5 Updates: $50 (one-time fee for 5 additional updates that month)
Unlimited Updates: $100 (one-time fee for unlimited updates that month)

Unused updates (included or purchased) do not roll over to the following month.

8. Third-Party Services & Client Responsibilities

Our monthly subscription covers website design, hosting, and SSL. The following services are not included and are the client's responsibility to purchase and maintain separately:

Domain Names: You are responsible for purchasing and renewing your own domain name (e.g., yourbusiness.com) through a domain registrar of your choice.
Email Hosting: Business email services (e.g., yourname@yourbusiness.com) are not included. You may use providers like Google Workspace, Microsoft 365, or others.
Third-Party Plugins & Integrations: Any paid plugins, software subscriptions, booking systems, payment processors, or third-party tools required for your website are your responsibility.
Stock Photos & Licensed Content: If premium stock images or licensed content is needed beyond what we provide, associated costs are your responsibility.

We're here to help: While these services are not included in your subscription, we're happy to guide you through the setup process, recommend providers, and assist with connecting your domain, email, or third-party tools to your website. Just reach out and we'll walk you through it.

9. Acceptable Use

You agree not to use our services for:

Illegal activities or promoting illegal activities
Distributing malware, viruses, or harmful code
Spam, phishing, or fraudulent schemes
Content that infringes on intellectual property rights
Hate speech, harassment, or discriminatory content
Adult content without proper age verification
Any activity that violates applicable laws or regulations

We reserve the right to suspend or terminate services for violations of these terms.

10. Service Availability

We strive to maintain 99.9% uptime for all hosted websites. However, we do not guarantee uninterrupted service and are not liable for any downtime or data loss. We recommend maintaining backups of any content you provide to us.

11. Limitation of Liability

To the maximum extent permitted by law, Free Web Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of our services.

12. Indemnification

You agree to indemnify and hold harmless Free Web Design, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these terms.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of significant changes via email or by posting a notice on our website. Continued use of our services after changes constitutes acceptance of the new terms.

14. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
